Breaking News: A judge said he planned to dismiss Sarah Palin’s libel lawsuit against The Times when jurors, who are still deliberating, finish their work.
The judge, Jed S. Rakoff, said that Ms. Palin's legal team had failed to prove that the newspaper acted with actual malice when it published a 2017 editorial erroneously linking her to a mass shooting.
His unexpected decision came during the second day of jury deliberations. He indicated that he believed an appeal by Ms. Palin was likely, and he said that the appeals court "would greatly benefit from knowing how the jury would decide" the case.
